BREAKING : Again Court Bars Etim, Others From Parading As C'River APC Excos


Justice Achu Ewah of the Cross River High Court has insisted that the motion Ex-parte which stops the  Mr.Etim John led Executive Committee of the All Progressives Congress in Cross River state sustains.

This is also as the court insist that the affected exco is restrained from acting, functioning or performing the duties of an authentic state exco of the party.

The Court had on May 30th, 2018 granted prayers by the Plaintiffs, Dr. Matthew Achigbe to restrain the Respondents, Mr. Etim John and others from functioning as members of the state executive committee of the party in the state.

In its renewed sitting today, Thursday, June 7, 2018, the court granted a further prayer by the plaintiff's counsel, Barr.Joe Oloko to allow the service of the processes on the respondents whom he allegedly were evading  service.

He alluded that substituted service was the only available option to call the respondents' attention to the litigation.

Counsel to the respondents, Lazarus Undie had prayed the court to vacate the order of interim injunction because the processes have not been duly served the respondents.

He had said his appearance in court today was in protest against the delay in the  service process contending that the plaintiffs cannot afford to hold the court to ransom.

In his ruling, Justice Ewah urged that the respondents act expeditiously in filing the application for substituted service so that parties can appear at next adjourned date for hearing.

He however sustained the injunction and adjourned the matter to Thursday, June 14 for hearing.

The plaintiffs in the suit, Dr  Achigbe and others are challenging the purported emergence of the Etim John led executive committee during the May 21state congress, a process he argued was fraught with discrepancies and therefore contradict the party's statutes and of the electoral act.
